These Terms of Use govern your access to and use of the website shinebeauty.world and the online wellness programs offered by Shinebeauty, including Desk Mobility Essentials, Focus & Posture Pro, and the Executive Wellness Bundle. By accessing our website, creating an account, or purchasing a program, you agree to be bound by these terms. If you do not agree, you must not use our services.
In these Terms of Use, the following definitions apply:
Shinebeauty is a provider of online wellness programs for office workers, based at Weteringschans 110, 1017 XS Amsterdam, Netherlands. Our programs are educational wellness resources designed to support desk-side movement, posture awareness, and focus-building habits. To use our programs, you must be at least eighteen years of age and capable of entering into a binding agreement under applicable law. By using our services, you represent and warrant that you meet these requirements. If you are purchasing on behalf of a company or organisation, you represent that you have authority to bind that entity to these terms.
Access to purchased programs requires creation of a user account. You agree to provide accurate, current, and complete information during registration and to update your information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify Shinebeauty immediately at admin@shinebeauty.world if you suspect unauthorised access to your account. We reserve the right to suspend or terminate accounts that violate these terms or contain false information.
Program prices are displayed on the movement-programs page and include applicable VAT for consumers in the Netherlands. Prices are subject to change, but changes will not affect purchases already completed. Upon successful payment, you receive access to the purchased program for the Subscription Period. Payment is processed through secure third-party payment providers. Shinebeauty reserves the right to refuse or cancel orders in cases of pricing errors, suspected fraud, or violation of these terms.
Upon purchase, Shinebeauty grants you a personal, non-exclusive, non-transferable, revocable license to access and use the purchased program Content for your own personal or internal workplace wellness purposes during the Subscription Period. You may not:
All Content, trademarks, logos, program structures, and platform technology are the intellectual property of Shinebeauty or its licensors and are protected by copyright, trademark, and other intellectual property laws. Nothing in these terms grants you ownership of any intellectual property. Unauthorised use of our intellectual property may result in legal action.
Our online wellness programs provide general educational guidance on desk-side movement, posture, and focus techniques for office workers. The Content is not a substitute for personalised professional advice. You should assess your own physical condition and workspace before participating in any guided session. If you experience discomfort during a session, stop immediately and consult an appropriate professional. Shinebeauty does not guarantee specific outcomes from program participation.
We strive to maintain continuous access to the Platform but do not guarantee uninterrupted availability. Scheduled maintenance, technical issues, or circumstances beyond our control may temporarily affect access. We will make reasonable efforts to notify users of planned maintenance in advance. Shinebeauty is not liable for temporary unavailability of the Platform.
You agree to use the Platform and programs in a lawful and respectful manner. Prohibited conduct includes harassing other users or staff, submitting false information, attempting to gain unauthorised access to systems, interfering with other users' experience, and using the Platform for any unlawful purpose. Violations may result in immediate suspension or termination of your account without refund.
You may close your account at any time by contacting admin@shinebeauty.world. Shinebeauty may suspend or terminate your access if you breach these terms, engage in fraudulent activity, or if required by law. Upon termination, your license to access Content ceases immediately. Provisions that by their nature should survive termination, including intellectual property, disclaimers, and limitation of liability, will remain in effect.
Refunds are governed by our Return Policy, which forms part of these terms. Please review that policy for eligibility criteria, timeframes, and the refund request process applicable to program purchases in the Netherlands.
Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using our services, you acknowledge that you have read and understood our Privacy Policy.
Our website may contain links to third-party websites or services, including embedded maps and payment providers. Shinebeauty is not responsible for the content, privacy practices, or availability of third-party sites. Accessing third-party links is at your own risk and subject to their respective terms.
To the fullest extent permitted by applicable law, Shinebeauty and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or programs, including loss of profits, data, or goodwill. Our total liability for any claim arising from these terms or your use of our services shall not exceed the amount you paid for the relevant program during the twelve months preceding the claim. Nothing in these terms excludes liability that cannot be excluded under Dutch law, including liability for death or personal injury caused by negligence or for fraud.
You agree to indemnify and hold harmless Shinebeauty from any claims, damages, losses, or expenses arising from your violation of these terms, misuse of the Platform, or infringement of third-party rights through your use of our services.
These terms are governed by the laws of the Netherlands. Any disputes arising from or relating to these terms or our services shall be submitted to the competent courts in Amsterdam, Netherlands. As a consumer resident in the European Union, you retain any mandatory rights under the laws of your country of residence. You may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
We may update these Terms of Use to reflect changes in our services, legal requirements, or business practices. Updated terms will be published on shinebeauty.world with a revised date. Material changes affecting active subscribers will be communicated via email or platform notification at least thirty days before taking effect. Continued use after the effective date constitutes acceptance of the updated terms.
If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
